A grieving man has claimed he was compelled to pay £3,000 after Birmingham City Council pursued him for a Clean Air Zone fine incurred by his late father.
Gary Davies, a 52-year-old roofer from Tamworth, expressed frustration at being unable to convince the local authority of his father’s passing, describing the ordeal as like “talking to a brick wall.”
The council, defending its administration of the Clean Air Zone (CAZ) scheme, maintained that opportunities for appeal were clearly outlined.
The zone, introduced in 2021 to combat poor air quality, imposes daily fees on older vehicles entering the city centre. While a report in January highlighted a “significant” reduction in pollution, the initiative has faced mounting criticism over its handling of fines.
Mr Davies explained that enforcement agents clamped two vehicles outside his property, leaving him with no option but to pay £3,000. Despite submitting a copy of his father’s death certificate, he has yet to receive a refund.
Recounting his attempts to resolve the matter, he said, “I was on the phone for two-and-a-half hours one day trying to speak to somebody. It makes you feel like you’re an absolute loser because nobody will listen to you.”

“I don’t know why they only give you a short timeframe to pay the fine,” she said. “They should give people notice of one or two weeks more.”
Responding to the criticism, Councillor Majid Mahmood, cabinet member for environment and transport, asserted that the council adhered to a statutory enforcement process.
He explained that penalty charge notices are issued based on the registered keeper’s information held by the DVLA at the time of the offence.
“The opportunities for challenge are very clearly set out at each stage of the process so that anyone issued with a penalty charge notice understands how they can pay or challenge it,” Mahmood stated.
As discontent grows, affected motorists like Gary Davies are left hoping for a resolution that acknowledges their circumstances rather than automated responses and escalating fines.
